GENERAL TERMS AND CONDITIONS OF SALE FOR ONLINE PURCHASES ON THE SITE ANTICAFORNERIAPREZIUSO.IT
Antica Forneria Preziuso - The Flavors of Nature, with registered and administrative office in Recanati (MC), Via Iginio Simboli 4, registration number in the Macerata Business Register - MC158321 - and tax code PRZLNZ 68C22 H211R, VAT no. 01507800439, makes available to all users the possibility to purchase Antica Forneria Preziuso branded products via the Internet through the website www.anticaforneriapreziuso.it and www.biscottibiologici.it, of which it is the sole and exclusive owner.
1) GENERAL NOTES
These general terms and conditions of sale ("General Conditions") are governed by the Consumer Code (Legislative Decree no. 206/2005), section II, Distance Contracts (arts. 50 – 67) and by the regulations on electronic commerce (Legislative Decree no. 70/2003) and apply exclusively to the sale of Products via the Internet, as identified and listed in the "Buy" section of the Site. The Customer is invited to print or save these General Conditions in their preferred manner. In the event of changes to the General Conditions, the General Conditions published on the Site at the time the Order is sent by the Customer will apply to the purchase order.
2) PUBLIC OFFER
The Products and their respective Prices presented on the Site constitute a public offer in accordance with the procedures specified in the General Conditions and on the Site itself. The conditions of this offer apply exclusively to purchases made on the Site.
The purchase contracts concluded on the Site are entered into with Antica Forneria Preziuso - I sapori della Natura.
3) PRICES
All prices include VAT. Delivery costs are borne by the Customer and are duly highlighted in the Purchase Order. The Products are subject to the Price shown on the Website at the time of the Order, without any consideration of previous offers or any subsequent Price changes. If the ordered products are to be delivered outside Italy, you may be subject to customs duties and import taxes. Customs duties or import taxes must be paid when the order reaches the destination country. All additional taxes related to the clearance of orders are the responsibility of the customer.
4) ORDER
Purchase Orders must be placed online through the order procedure available on the Site, in the section: "How to Buy Online". In order to proceed with filling out the Purchase Order, the Customer may, alternatively, follow these methods:
a) If the Customer is already registered on the Site, through the appropriate Section login it will be sufficient to enter their access credentials (username and password) and access the cart.
b) If the Customer is not a User, it will be sufficient to enter in the appropriate registration form the required data necessary to make the Purchase.
The Purchase Contract will be considered concluded at the moment Antica Forneria Preziuso - I sapori della Natura receives the Order. In this case, Antica Forneria Preziuso - I sapori della Natura will acknowledge receipt of the Order by sending an order confirmation email to the email address provided by the Customer. This Confirmation will summarize the selected Products, the related Prices (including delivery costs), the delivery address, and the order number. The Customer undertakes to verify the accuracy of the data contained in the Order Confirmation and to notify Antica Forneria Preziuso - I sapori della Natura of any corrections within 24 (twenty-four) hours of receiving it. Any additional costs resulting from errors in the data not promptly reported will be borne by the Customer. The Order Number, generated by the system and communicated by Antica Forneria Preziuso - I sapori della Natura, must be used by the Customer in all communications with Antica Forneria Preziuso - I sapori della Natura. It is possible that occasional unavailability of the Products offered may occur; in this case, if the Products chosen by the Customer are not, in whole or in part, available, Antica Forneria Preziuso - I sapori della Natura will inform the Customer.
5) PAYMENT METHODS
Payment can be made online by credit card, PayPal, and bank transfer in advance according to the methods specified on the site. At the same time as the Order Confirmation is communicated, the corresponding amount for the purchased Products will be charged to the Customer.
a) Online Credit Card
The accepted credit cards are: Visa, Mastercard, American Express. All data is transferred in encrypted form using an SSL certificate and therefore cannot be intercepted by external parties. Furthermore, the data is entered directly on the bank's website, thus ensuring maximum security.
b)PayPal
Once payment with PayPal is completed, the buyer will be redirected to the PayPal site, where they can access their account by entering their personal email address and password. After registration, it is possible to proceed with payments via PayPal without having to re-enter the data, even for subsequent purchases. By choosing to pay with PayPal, the amount is charged directly to the assigned credit card (Visa, Visa Electron, Mastercard) or prepaid card (PostePay). PayPal protects the buyer's information as no financial information is shared.
In case of payment by PayPal, Postepay, and Credit Cards, a fixed fee of 0.35 euros will be added, as well as a surcharge ranging from 3.4% (Italy and EU countries) to 5.2% (non-EU countries) on the total order amount.
c) Advance Bank Transfer
The user can make the payment by bank transfer in favor of Antica forneria Preziuso- I Sapori della natura IBAN: IT 04 T 08765 69130 000010100904 - BIC/SWIFT ICRAITRRL90. The goods will be sent to the customer after the bank notification or upon receipt of the CRO number sent by the customer via e-mail to info@anticaforneriapreziuso.it
Antica Forneria Preziuso - The Flavors of Nature will issue an invoice for the purchased Products, sending it by e-mail to the order holder. The information provided by the Customer will be used for the issuance of the invoice. No changes to the data will be possible after the invoice has been issued.
6) DELIVERY METHODS
Antica Forneria Preziuso - The Flavors of Nature, will deliver using specialized couriers, only in the areas specified on the Site.
At the time of Delivery, the presence of the Customer or a trusted person is required to check that the packaging is intact and clean and that the Products received correspond to what is stated on the Order. In case of visible defects, such as incorrect quantity and/or wrong Product and the lack of integrity of the packaging, the Customer or their trusted representative must report this on the delivery document and contact Antica Forneria Preziuso - The Flavors of Nature at the link "Contact Us" within and no later than 24 hours from Delivery. Once the courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of what has been delivered. Even if the packaging is intact, the goods must be checked within 24 hours of receipt. Any hidden anomalies must be reported in writing by fax or registered letter with return receipt. Any report beyond the aforementioned terms will not be taken into consideration. For every statement, the customer assumes full responsibility for what is declared.
Antica Forneria Preziuso - The Flavors of Nature, delivers the purchased Products to the address indicated by the Customer, with the following methods:
a) Orders: At the time of placing the Order, the estimated Delivery date will be indicated – 5 days for Italy (excluding islands) and 10 days for other countries. This date is only indicative, therefore no responsibility can be attributed to Antica Forneria Preziuso - The Flavors of Nature in case of failure to comply with it. Delivery will take place without prior appointment and is intended at street level and
will be carried out by DHL courier between 8:00 am and 7:00 pm from Monday to Friday. If the shipment cannot be delivered on the first attempt, a new delivery attempt will be made. In the event of failure to collect within 5 working days the goods held in storage at the courier's warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of the order, the ordered goods will be returned to the warehouses of Antica Forneria Preziuso - The Flavors of Nature. Arrangements will be made for a new shipment and the related additional shipping costs.
b) Orders Delivered to a pick-up point Antica Forneria Preziuso - The Flavors of Nature (Pick-Up Point): Antica Forneria Preziuso - The Flavors of Nature, as an alternative to the previous Delivery Methods, offers its Customers the possibility to collect the purchased Products at Antica Forneria Preziuso - The Flavors of Nature, Via Iginio Simboli 4 - 62019 Recanati MC. Collection of goods can be made from Monday to Friday from 8:00 am to 1:00 pm and from 5:30 pm to 7:30 pm.
7) Support services
The Customer can obtain information regarding after-sales assistance services by contacting Antica Forneria Preziuso - I sapori della Natura through the channels listed in the "Contact Us" section.
8) RIGHT OF WITHDRAWAL
By express derogation from the provisions of Art. 47 of the Consumer Code (Legislative Decree 06.09.2005 no. 206) and in legitimate application of Art. 46, paragraph I, letter (b) of the aforementioned Code, given the nature of the goods - perishable products - supply of food and beverages - subject of this contract, the right of withdrawal cannot be exercised.
9) PROCESSING OF PERSONAL DATA
Customer data is processed by Antica Forneria Preziuso - I sapori della Natura in accordance with the provisions of the regulations on the protection of personal data, as specified in the information provided in the specific section "Information pursuant to art. 13 of Legislative Decree 30/06/2003".
Antica Forneria Preziuso - The Flavors of Nature will process the personal data provided by the Customer for the online purchase of Antica Forneria Preziuso - The Flavors of Nature Products, in compliance with personal data protection regulations and mainly in electronic form. The processing will concern the operations, or the set of operations (such as, by way of example: collection, registration, organization, storage, processing, communication, modification, selection, use, deletion, destruction), concerning the personal data provided by the Customer when filling out and sending the online Purchase Order for the Products.

With regard to the purposes referred to in points 1), 2) and 3), the provision of data, although optional, is necessary for the execution of the online purchase service and any refusal to provide them will make it impossible for Antica Forneria Preziuso - I sapori della Natura to provide the same. For the processing of data for the purposes referred to in points 1), 2) and 3), it is not necessary to obtain the Customer's consent. For the proper performance of the aforementioned activities, the data will mainly be accessed by the after-sales service staff of Antica Forneria Preziuso - I sapori della Natura. Furthermore, the data may be made available exclusively for the performance of the activities delegated to them, to the suppliers of Antica Forneria Preziuso - I sapori della Natura who provide services related and functional to the aforementioned purposes, such as, in particular, companies that provide IT services, including hosting services, companies that perform commercial services on behalf of Antica Forneria Preziuso - I sapori della Natura (e.g. data entry, transport and delivery). These subjects mainly operate as data processors for Antica Forneria Preziuso - I sapori della Natura.

The Customer's data will not otherwise be disclosed or shared with third parties.
The Customer's data will be kept for the time strictly necessary to carry out the activities referred to in points 1), 2), and 3).

With regard to the processed data, the Customer has the right at any time to exercise the rights recognized by art. 7 of Legislative Decree 196/2003 and, in particular, among others, to obtain a copy of the processed data, their updating, correction or integration, their deletion, transformation into anonymous form or blocking for processing in violation of the law, to object for legitimate reasons to the processing.

11) COMPETENT COURT
The distance sales contract between the Customer, whether Italian or not, and Antica Forneria Preziuso - I sapori della Natura is to be considered stipulated and concluded in Italy and therefore governed by Italian law, so the conditions of sale will be regulated by the laws in force in the Italian state whether the product is sold in Italy or abroad. If the Customer is a consumer, any civil and/or criminal dispute relating to the application, execution, interpretation, and violation of the distance sales contract will fall under the territorial jurisdiction of the court of reference where the Customer has their residence or domicile, if located within the territory of the Italian State. In all other cases (e.g. if the Customer has their residence or domicile abroad or lives abroad), the exclusive territorial jurisdiction is that of the Court of Macerata (Italy).
for the fulfillment of any legal and/or regulatory obligations (e.g. tax and accounting obligations), group reporting, internal controls;
for the management and execution of the contract that may be concluded between Antica Forneria Preziuso - I sapori della Natura;
for the fulfillment of obligations arising from and connected to the contract, such as, by way of example and not limitation: execution of transport services and after-sales customer support.
